Terms of service
These terms are between Feisal Omar ("we") and the cargo house using Barxad Status ("you"). They do not create any agreement with your clients: your relationship with them, and what you promise them about their cargo, is yours.
1. What the service does
Barxad Status records the status of consignments, gives each one a tracking page, and writes the WhatsApp message that tells a client when something changes. Your origin agents and your Nairobi office write to the same record, so there is one answer to "where is my cargo".
It is a record-keeping tool, not a tracking device. It knows what your staff last told it. It has no connection to any carrier, port, airline or customs system, and it cannot know where cargo actually is.
2. Sending messages
Unless a WhatsApp provider has been configured for your account, the service does not send anything by itself. It prepares each message and a member of your staff sends it. A screen saying a message is "prepared" means it is waiting for a person. If you tell your clients they will be messaged automatically, make sure that is actually switched on.
You are responsible for having your clients' agreement before messaging them, and for honouring a client who asks you to stop. The service will not prepare a message for a client whose agreement is not recorded, and it stops messages for anyone who replies STOP — but the obligation to respect that is yours, including when you contact them by other means.
3. Your data
The shipment records, client details and messages in your account are yours. We hold them to run the service and for no other purpose. We do not sell them, do not use them to train anything, and do not share them with other cargo houses.
You can export your shipments as a spreadsheet at any time from the dashboard. If you end your use of the service, ask us and we will give you a complete copy and then delete it. See the privacy policy for what is held, where, and for how long.
4. Accounts and access
You decide who in your business gets an account and what role they have. Keep sign-in details to the person they belong to, and remove people who leave. An origin agent's link signs them in, so treat it like a password: if a phone is lost, rotate that agent's link, which signs them out everywhere at once.
Anything done by an account is treated as done by you.
5. Availability
We aim to keep the service running and to fix problems quickly, but we do not promise a particular level of uptime and there is no service credit. The service depends on infrastructure we do not control, and on your staff having a working connection.
Your business should not depend on this service being reachable at a particular moment. Keep whatever paper or chat records your operation needs to function without it.
6. Acceptable use
You agree not to:
- use it to message people who have not agreed to hear from you, or who have said stop
- record information about a person that you have no business reason to hold
- put anything in a delay reason that the client should not read — they see it word for word
- attempt to reach another cargo house's data, or test the service's security without asking us first
- resell or re-badge the service as your own product without a written agreement
7. Fees
Fees, billing period and notice are as separately agreed in writing with you. Nothing on this page sets a price. [CONFIRM THE COMMERCIAL TERMS IN WRITING BEFORE RELYING ON THIS SECTION.]
8. Liability
The service is provided as it is. We are not liable for losses arising from cargo being late, lost or misdescribed, from a status your staff entered incorrectly or did not enter, or from a message your staff did not send. Those are consequences of how the cargo was handled and how the record was kept, not of the software.
We remain responsible for our own acts in holding your data, and nothing here limits liability that cannot be limited by law.
9. Ending it
You may stop using the service at any time, and ask for your data. We may suspend an account that is being used in breach of section 6, or where fees agreed in writing remain unpaid after notice. If we discontinue the service we will give you reasonable notice and time to export.
10. Changes
If these terms change in a way that affects you, we will tell you before the change takes effect. The date at the foot of this page shows when the current wording started.
11. Governing law
These terms are governed by the laws of Kenya, and the courts of Kenya have jurisdiction.
